Beatle Ringo Starr braved the
rain yesterday (MON) to visit the Chelsea Flower Show and joked "The
problem we've got is that we're sinking up to our necks." Ringo,
together with wife Barbara Bach, was officially opening the 4head
garden - one of the main exhibits at the show which featured the
sculpture of a giant naked woman covered in grass reclining by a pool.
Ringo said: "I wonder if
the green lady has got a good soaking?" He added: "Gardens are part of
our heritage. We love the smells and the colours - I have a garden
myself and I love the garden but I don't actually do the gardening.
We're vegetarians and we grow a lot of fruit and veg ourselves. We
actually get about 80 per cent of our food from the garden.
"I've got many acres. I'm
not telling you how much, but it's more than Chelsea. We've got a head
gardener and several under gardeners." When asked whether he was saving
water in light of the hosepipe bans in place in parts of the country he
joked: "I've all my hosepipes going."
Ringo was also asked about
what he thought of Paul McCartney's split with Heather, but he remained
tight lipped, only saying with a smile: "She's a lovely girl." The
4head garden, which includes woodland and more than 7,000 plants and
healing herbs, is sponsored by 4head, the natural treatment for
headaches - in recent clinical trials the treatment was shown to start
working within two minutes. Ringo was supporting the POD charity which
organises children's entertainers for youngsters in hospitals and
hospices throughout the UK.
Carefully walking around
the garden so as not to slip, Ringo said: "This garden is great. It's a
full of herbs. I love the woman and I love the flowers and the grass.
We're here to promote POD. It does a great job in entertaining kids in
hospital." This is the third year Ringo has supported the 4head garden
at the show - and he often takes back a memento of his visit from the
garden. This year it's thought he might choose the huge 10ft high
driftwood sculpture in the garden, which took two weeks to create.
Ringo said: "We always say
we're not going to get another bench but we always do - we bought back
a bench last year, so who knows this year?"

AND HEATHER
Having tried exceptionally hard
to make our relationship work given the daily pressures surrounding us,
it is with sadness that we have decided to go our separate ways. Our
parting is amicable and both of us still care about each other very
much but have found it increasingly difficult to maintain a normal
relationship with constant intrusion into our private lives, and we
have actively tried to protect the privacy of our child.
Separation for any couple is
difficult enough, but to have to go through this so publicly,
especially with a small daughter is immensely stressful.
We hope, for the sake of our baby
daughter that we will be given some space and time to get through this
difficult period.

By now you will have probably
heard the unfortunate news that Heather and I are going our separate
ways. We have issued a statement expressing our sadness at this turn of
events but I would like to let people know my feelings about some of
the stories which have appeared in the media over the past few days.
I'm really disappointed that
during a very difficult and emotional time for both Heather and myself
there are certain people in the media who are writing things about
Heather that are just plain untrue. It's been suggested that she
married me for the money and there is not an ounce of truth in this.
She is a very generous person who spends most of her time trying to
help others in greater need than herself. All the work she does is
unpaid so these stories are ridiculous and completely unfounded. I'm
very sad to see that some insensitive people would choose a moment like
this to spread these vicious rumours.

Beatles' Apple Corps. Loses Trademark Case Against Apple Computers.
As
a result of this ruling, the Beatles must pay thir own legal expenses,
estimated
at £2m.
A lawyer for Apple Computers asked Mr Justice Mann for a £1.5
million interim payment for his side's costs, which could top more than
another million. However, the judge refused this payment, pending
further
hearings.
The ruling means iPods and iTunes will still be able to carry
its Apple name and logo.

APPLE CORPS LIMITED
When the two Apple companies reached their agreement in October 1991
over future use of the apple name and marks, they did so on the clear
basis that Apple Computer would be unable to use these on or in
connection with pre-recorded music. That was to remain the exclusive
province of The Beatles' company, Apple Corps. The launch by Apple
Computer of its iTunes website selling pre-recorded music, coupled with
its extensive marketing and advertising campaign, clearly, in our view,
broke that agreement because the apple name and logos were and are used
very extensively in connection with pre-recorded music.
Commenting on the judgment handed down today by Mr Justice Mann, Neil
Aspinall, Manager of Apple Corps, said:

respect to the trial judge, we consider he has reached
the wrong conclusion. We felt that during the course of the trial we
clearly demonstrated just how extensively Apple Computer had broken the
agreement. We will accordingly be filing an appeal and putting the case
again to the Court of Appeal. We have been advised by our legal team,
including two eminent specialist QCs and our solicitors Eversheds, that
we have every prospect of reversing this decision on appeal.”

EVERSHEDS' COMMENTS ON Apple v Apple DECISION
Commenting upon
the judgment in Apple Corps v Apple Computer handed
down by Mr Justice Mann today, 8 May 2006, Nicholas Valner, partner at
Eversheds, solicitors to The Beatles' Apple Corps Ltd, said:
"This is a
particularly disappointing decision. The judgment is
curious. So much of what the judge says is right. It will be noted that
he rejected pretty much every argument advanced by Lord Grabiner for
Apple Computer.
He expressly
found (paragraph 83) that Apple Corps' exclusive
province includes recordings transmitted in intangible form and says
"[Apple] Computer has no right to apply its marks to such matters". He
thereby expressly agreed with Mr Vos' submission (paragraph 60) that
Apple Corps' area of exclusivity covers a download over the internet.
But since the
only visible element in such a music download process
would be a store like iTunes Music Store (or one of its rivals)
appearing on a computer screen, it is inconsistent then to hold, as the
judge does, that the use of the apple logos is not use in connection
with the downloaded music.
The way the judge
seeks to avoid this inconsistency is two-fold:
first, he places a narrow construction upon the words "on or in
connection with", and expressly rejects their normal English meaning in
favour of a very limited 'trade connection' sense. In doing so, the
judge ignores what is referred to as 'the Golden Rule' of
construction[1] - that the words of a contract should be construed in
their grammatical and ordinary sense. Secondly, he gives an
interpretation of clause 4.3 of the contract (the clause is set out on
page 6 of the judgment) which Counsel for neither party advanced
because they both knew it was wrong. It involves implying into it the
words "fair and reasonable use when applied to the service" (see
paragraph 78). English law on implied terms is clear: terms cannot be
implied if they contradict express terms in the contract. Since the
judge's implied term imported into clause 4.3 has the direct effect of
contradicting the clear terms of clauses 4.2 and 4.9 (which expressly
forbid App
le Computer from using their marks on or in connection with Apple
Corps' exclusive field (which includes downloaded music - as the judge
concedes)), the judge cannot be right.
It is for these
reasons, among others, that Apple Corps has been
advised that an appeal has every prospect of success. It will be
appealing."

2006 - Corrected Editions Of “The Capitol Albums Vol. 2" Now Available
In Canada: Earlier today I
received a much awaited call from “Sam
The Record Man” in downtown Halifax, informing me that a
corrected edition of “The
Capitol Albums Vol. 2”
would be held for pickup at my convenience.
Upon entering the store I was
pleased (and relieved) to observe several copies of “The Capitol Albums Vol. 2”
all with the “SK1”
extension present on the yellow label.
In addition to be pleased with the
conclusion of this transaction, this experience was unique to what I’ve
observed with other retailers. During the release week of April 11th, I
contacted “Sams” and was
specifically notified that this particular outlet would not be selling “The Capitol Albums Vol. 2” until the corrected edition was made
available. As I was giving my name and contact info, I couldn’t help
but be impressed that a retailer would assume this stand on behalf of
their consumers. I can assume that lost sales during the past three
weeks and endless inquiries must have been an issue for them. By
contrast, most retailers seem to have no problem
selling the incorrect sets even after being notified of the error by
their customers (as I have done on several occasions).
As I made my purchase, I felt
pleased to be supporting a retailer of integrity. As far as I know, “Sams” is the only retailer in
my area that is currently selling the correct edition of “The Capitol Albums Vol. 2”. I am not professionally associated
with “Sams” but I am
compelled to give them some recognition, both as a show of gratitude
but also to inform other consumers where this much awaited release can
be obtained in it's intended form.
